Types of products

We distinguish between cartable products that are priced and ready to be carted and paid for online. Some may be in stock within Australia and some may need to be ordered from overseas and non-cartable products.

Non-cartable products may be a standard-made product that is personalised or customised for you specifically (such as a chair that is polished/painted and upholstered in a fabric, purchased from us separately).

Or, a non-cartable product may be especially designed and custom made for you as well finished and or upholstered for you.

Some of the delivery times, terms, conditions and refund policy differ depending on the type of product as described above.

1. Online orders – cartable products with stated price

a) Full Payment for goods must be made at the time of purchase. Christophe Living and Christophe Design reserves the right to decline or accept orders made through its Websites or relates online sites, and from time to time, Christophe Living and Christophe Design and Christophe Design may need to restrict the quantity of specific goods.

b) Lead-times are an approximation only and are subject to variation.  Sometimes, certain goods may be out of stock or may require longer than estimated arrival or shipping times. If your order is unable to be fulfilled at all by us or by our supplier, we will either refund you the price paid or offer a store credit. Many of our cartable products come from overseas and we cannot foresee factors outside our control such as shipping and custom delays as well industrial action. These factors will not form the basis for a cancellation or refund request and we will communicate any delays as promptly as possible.

c) Delivery fees will depend on where your order is being delivered, the size of the package and the weight. An adult over 18 must be able to accept the delivery of goods at the delivery address supplied by the customer. Unanticipated circumstances may impact delivery timeframes.

As the delivery fee is calculated individually due to the nature of our products we cannot offer a predetermined fee at the time of online ordering. We will call or email you the deliver cost separately.

By placing your online order you accept that your delivery will be charged separately.

d) Products bought online with‘free delivery’ refer to Australian metropolitan areas only at the discretion of Christophe Living and Christophe Design. For order outside these areas, the delivery fee will need to be individually quoted and agreed to. For online orders with international delivery, costs need to be individually quoted.

e) Christophe Living and Christophe Design reserves the right to decline or accept any orders made for delivery to metropolitan, regional or remote areas, both within Australian and internationally, for any reason including supply, costs or access. In these cases we will cancel the order and refund the price paid or offer store credit.

 

f) It is the customer’s responsibility to ensure that the correct delivery address, contact details and email address are provided. It is the customer’s responsibility to inform Christophe Living and Christophe Design of any issues, difficulties or specific requirements associated with the delivery of goods and to ensure that the item ordered is capable of delivery such as through doorways and up stairs (for example). It is the customer responsibility to organise and schedule access and installation of protective lining to interior of lifts, access to loading areas, and parking reservation where needed.

g) All online purchases are subject to our Products and Services Policy and our Returns and Refund Policy.

2. Products and services policy for non cartable products

Payment

A deposit of 50% of the total order cost is required upon receipt of a pro forma invoice. Final payment is due prior to delivery or pickup.

Notification will be given upon completion of your order at our workshop and upon request we can send you photos of the completed item for inspection.

We accept payment by EFT, cheque and Visa and Mastercard credit cards. A 1.5% surcharge applies for all credit card payments. This fee will be invoiced separately to the order.

You are solely responsible for meeting the payment terms on orders made by you for yourself or business or on behalf of your customers.

Custom furniture and custom builds 

Due to the nature of designing unique custom furniture, it is usual that the customer orders the piece based on sketches and plans. While Christophe Living and Christophe Design takes all reasonable steps to ensure the specifications are met, due to the nature of the creative and craftsmanship process – it is usual that some variation will occur between the plans and the final product.

This is due to the hand made nature of the product and the use of natural materials like timber, fabrics and paints. Customers who order customised furniture or customized pieces are taken to accept that minor variations (such as in size, finish, carving, assemblage and design) are part of the creative and manufacturing process of creating handcrafted furniture.

Design advice

Our designer takes all reasonable measures to inform clients as to the suitability regarding various products, designs, hardware and fabric selections. The client, however, assumes responsibility for all final selections made. This applies in the event that a customer has a change of mind regarding a design or fabric selection after upholstery, manufacture, installation or delivery or after that component has been ordered. No refund or replacement is available for change of mind. All changes requested will need to be paid for by the customer. If a customer’s final selection of a product, design, fabric or supplier are contrary to the advice or recommendations of the designer in good faith, the customer bears full responsibility for the selection and bears all costs for any changes requested.

Installation

It is the customer’s responsibility to ensure that the foundation or surrounds upon or within which installation of a Christophe Living and Christophe Design product is to take place are stable, in line with building standards and structurally sound.

We take no responsibility for issues relating to the work by other trades, which may by consequence cause damage to our product during or after installation. The damage so caused to our product due to others negligence or failure to inspect, is not our responsibility. Christophe Living and Christophe Design assumes the foundations upon which installations occur are structurally sound and ready for installation of our product (such as a marble bench top or free standing unit).

It is the customers responsibility to ensure that all tall structures ordered such as book cases, shelves or free standing units are adequately secured to the wall so as to ensure the safety of people at all times.

Installation fees are based on information provided and reasonable access at the delivery address. In the event that access is not reasonable or that unforseen installation issues arise, the customer bears the responsibility to pay the  associated additional charges an costs prior to delivery or installation.

Plumbing, electrical, building and council regulations

Where our products are to interface with electrical or plumbing it is the customer’s responsibility to ensure that all plumbing, electrical, builders and council specification are communicated prior to the design process.

We will not be responsible for any tradesmen damaging our products in the process of carrying out their work.

Furniture Specifications

All measurements on the website are approximate. As items are hand carved there may be small variations between each piece. If you are having furniture made to fit within a confined space, it is your responsibility to inform Christophe Living and Christophe Design of the maximum size specifications (in mm) and to check the measurements prior to order.

In relation to chairs and other legged furniture we level them before leaving the factory but cannot guarantee they will not rock on uneven (particularly tiled) floors

Fabric 

It is your responsibility to clearly specify upholstery details, intended use, level of wear, type of fibre preferred and any information that will assist in the selection process.

If you are supplying your own fabric or are a trade customer who orders fabric on behalf of a customer’s order please note the following:

It is your responsibility to check the fabrics before sending them to us to make sure that:

  • It is the right fabric, colour and pattern you wished to order
  • Check for any faults.
  • We will always use the inside of the roll unless specified to otherwise
  • Stripes will be upholstered up and down (vertically) unless specified otherwise
  • Velvet and pile fabrics will be upholstered with the pile facing down, this will result in the shade being different depending on the viewing angle on some section of the upholstered piece of furniture
  • We will attempt to match fabric in piping but this is not always possible.
  • Check that the pattern repeat works for the intended item
  • That is it has the right martindale rub factor (how hard wearing it is) for the intended use
  • That you advice the your customer of care and cleaning as well as fabric warranty and environmental factors such as light, sun and moisture that may affect or void the warranty.
  • Some thin fabrics and silks may require to be backed, you will need to get this done by an accredited professional yourself. If we feel that the fabric should be upholstered on top of calico we will let you know and advise you of the extra cost.

 

Also please note in relation to fabric that:

Some fabric houses request faults be reported within a set timeframe. We suggest that you have fabric delivered to you first for a thorough inspection within the fabric house defect reporting window.

We may not open the roll within this timeframe, or open the full roll before cutting, so will not be held responsible for issues that go unreported by you.

If required by your customer or statutory regulations to have fabric professionally flame proofed and stain guard treated, this falls under your responsibility. Please consult a professionally accredited company who can certify the treatment.

Timber and painted finishes

As timber is a natural product, some movement within timber pieces and joints is expected.

It is usual for painted furniture joints to show as hairline gaps. This is due to natural joint movement and the contrast between the timber and the painted finish. These hairline and joint gaps may increase with temperature and ambient moisture changes.

These are much less visible in timber polished finishes as the hairline gaps are usually the same colour as the finish.

It is normal that all finishes including painted finishes, antique finishes, timber finishes and decorative painting  is more susceptible to wear and greater care is required. You may want to consider a glass top to protect surfaces such as bedside table.

Delivery 

Final payment is required before delivery.

We use a number of professional transport companies, you may request to use your own.

Items are not insured during transit. You may organise transit insurance with your insurance agent. It is your responsibility to request insurance and pay for insurance.

For interstate transport some of our transport companies can supply an insurance quote. Otherwise you are free to organise your own transport insurance.

It is your responsibility to check that all details in an order are correct.

  • Access – that the furniture can be easily delivered and fits through doors, hallway, lifts etc
  • If lifts concierge need to be notified to protect lift internals please make sure to arrange this and coordinate with time of delivery
  • That the furniture is appropriate for the intended use and customer requirements
  • That customers are made aware of the warranty terms, care and factors that may void warranty (see warranty terms)

It is the customer’s responsibility to ensure that the correct delivery address, contact details and email address are provided. It is the customer’s responsibility to inform Christophe Living and Christophe Design of any issues, difficulties or specific requirements associated with the delivery of goods and to ensure that the item ordered is capable of delivery such as through doorways and up stairs (for example). ). It is the customer responsibility to organise and schedule access and installation of protective lining to interior of lifts, access to loading areas, and parking reservation where needed.

If extra costs are incurred for delivery due to from access issues (such as a lift being too small and furniture needing to be carried up stairs) that have not been disclosed the extra costs incurred will be charged to the customer.

If the goods are unable to be delivered due to access, the additional costs incurred for redelivery to our warehouse and storage will be to the customer.

Cancellation of the delivery time within 48 hours prior to the arranged delivery time will incur a minimum $120 cancellation fee.

Damaged or wrong Items

When an item is delivered it is required and expected that the item is inspected by the customer. Any visible damage to the items needs to be identified to the delivery driver at time of receipt. If the item is received in packaging, if any damage is noted, this needs to be reported to Christophe Living and Christophe Design within 48 hours of delivery. If Christophe Living and Christophe Design is not notified within the required 48 hours of delivery, then Christophe Living and Christophe Design is not able to take any responsibility for the damage.

The customer must inspect the products upon delivery to ensure they are the correct products. They must notify Christophe Living and Christophe Design with in 48hours if there are wrong products delivered. In this event, they must not continue to use, assemble or install the product.

If items need to be returned due to damage, wrong item, refund, repair or any other reason, while the item is in the care and possession of the customer, the customer assumes responsibility to care for the item(s). This means they must take all reasonable measures to ensure that the items are stored and packed safely and securely, that items are disassembled before being stored if that is necessary to keep them in good order and re packaging, that original packaging is used where possible or appropriate packaging is used to ensure the item(s) are not damaged. It is the customer’s responsibility to ensure that no damage occurs to the items whilst in the items are in the possession and care prior to purchase or redelivery.

Christophe Living and Christophe Design reserves the right to repair before replacing items.

Maintenance 

a) It is the customer’s responsibility to maintain and care for their furniture and products. As furniture is made of timbers, these require regular care and maintenance with the appropriate timber care products.

b) It is also the customer’s responsibility to position furniture with care.  If, for example, timber should not be exposed to sun, moisture or weather conditions, this may affect the finish and timber tone and integrity. In areas, such as Australia, where extreme weather climatic conditions are present, the customer also has responsibility to ensure their timber furniture is not exposed to extreme variations in temperature (For example, hot and cold conditions, followed by sudden air conditioner) which may cause cracking.

c) It is a normal reaction for timber to expand and contract with temperature changes. Top surfaces are more fragile and prone to scratches or wear and tear. Particular on painted finishes these can be more visible. It is the customer’s responsibility to be informed of this and to take measures such as coasters, table cloths, drawer liners or other necessary protections.

 

Lighting

It is the customer’s responsibility to ensure that lights are assembled and installed by a licensed professional, according to the IP ratings of the light. Lead times on lighting are approximations only and may be subject to change as many lights come from overseas.

3. Refunds and cancellations policy 

Please choose carefully as Christophe Living and Christophe Design does not refund or exchange for your change of mind or wrong selection. Once your order is confirmed, meaning you have either paid in full or made your first instalment, the order can no longer be cancelled. Even if the customer cancels the order they are liable for the final payment. Upon

Custom made orders: there are no refunds or cancellations after order confirmation for customized products, custom made products or special orders. Custom products are products that have been finished to suit your individual specifications and preferences (customization includes but is not limited to individually requested finishes, upholstery, fabric, dimensions, designs and ornamentation)

Special orders: are not returnable or refundable as these products (including lighting) are ordered specifically for the customer from national and international supplies as one off orders.

Faulty or damaged products: Christophe Living and Christophe Design reserves the discretion to repair, replace or refund at our own choice faulty goods.

When an item is delivered it is required and expected that the customer inspect the item. Any visible damage to the items needs to be identified to the delivery driver at time of receipt. If the item is received in packaging, if any damage is noted, this needs to be reported to Christophe Living and Christophe Design within 48 hours of delivery. The product must not be assembled, installed or used after notification of a fault.

If Christophe Living and Christophe Design is not notified within the required 48 hours of delivery, then Christophe Living and Christophe Design is not able to take any responsibility for the damage.

The customer must inspect the products upon delivery to ensure they are the correct products. They must notify Christophe Living and Christophe Design with in 48hours if there are wrong products delivered. In this event, they must not continue to use, assemble or install the product and must take care of the product.

We will not refund a faulty product if:

  • Too much time has passed. The right to a repair and replacement for faulty goods ends after a period of time has passed in which one would expect the problem to have become apparent; or
  • The product was damaged after being delivered to you.
  • The product was damaged during installed, used or assembled
  • The product was installed, assembled or used after observation or notification of the fault
  • The product was attempted to be repaired by someone other than Christophe Living or Christophe design.

 

We will not refund or replace a product if you have changed your mind about purchasing the product or made an incorrect choice.

Customer duty of care: If items need to be returned due to Christophe Living or Christophe Design for any other reason, the customer assumes full responsibility for the item(s) while they are in the care and possession of the customer. The customer must take all reasonable measures to ensure that the items are not damaged, are stored and packed safely and securely, that items are disassembled if required, before being stored and re packaging, that original packaging is used where possible or appropriate packaging is used to ensure the item(s) are not damaged.
